Nexgen Outfitters Suppressor & NFA Items Purchase Terms
By purchasing a suppressor, short-barreled rifle (SBR), short-barreled shotgun (SBS), or any applicable Gun Control Act (GCA)/NFA regulated item from Nexgen Outfitters, you explicitly agree to the following legally binding terms and conditions:
1. Age and Legal Residency Restrictions
Minimum Age: You certify that you are at least 21 years of age to purchase a suppressor, SBR, or SBS under federal GCA rules.
Form 4 State Shipping Prohibition: Suppressors are regulated under the National Firearms Act (NFA) and other applicable federal, state, and local laws. All suppressor purchases and transfers must comply with the laws and regulations in effect at the time of the transaction.
Certain states still require an ATF Form 4 process to possess a suppressor under state law. Nexgen Outfitters strictly prohibits shipping to any state where an ATF Form 4 is still legally required.
Prohibited Jurisdictions: We do not ship to any state or territory where suppressors are entirely banned or require Form 4 compliance (including but not limited to California, Rhode Island, Washington D.C., and the 15 states maintaining mandatory Form 4 status). You certify that you reside in one of the 27 approved free states where over-the-counter GCA transfers are active
2. No Returns or Cancellations
All Sales Are Final: In accordance with the Nexgen Outfitters Firearm Ordering Agreement, we do not accept returns or exchanges on any firearms, suppressors, or ammunition. All sales are final once processed.
No Cancellations for Background Check Delays: Orders cannot be canceled or refunded due to government processing times. Nexgen Outfitters has zero control over the speed of the National Instant Criminal Background Check System (NICS).
3. FFL/SOT Transfer & Shipping Policy
No Direct Home Delivery: In compliance with federal law, suppressors and GCA firearms cannot and will not be shipped directly to a residential address.
Delivery Options: All online orders must either be designated for In-Store Pick-Up at the Nexgen Outfitters showroom in Sidney, Nebraska, or shipped via Flat Rate shipping ($15 per firearm) to an appropriately licensed Federal Firearms Licensee (FFL) with Special Occupational Taxpayer (SOT) status where required by applicable law, within an eligible jurisdiction.
Documentation Window: For external FFL/SOT dealer shipments, you are responsible for ensuring your chosen transferring dealer provides the required current licensing and SOT documentation, as applicable to Nexgen Outfitters within 7 business days of order placement. Orders will be held until valid documentation is received.
Over-the-Counter Transfer: When picking up your item, the transfer is completed over-the-counter via a standard ATF Form 4473 and a live NICS background check. If an immediate "Proceed" status is granted, you may take the item home the same day.
4. Background Check Denials and Restocking Fees
Failed Background Checks: If your NICS background check returns a "Denied" status, or you are otherwise legally determined to be a prohibited person, you will not be permitted to take possession of the item.
Restocking Fee Penalty: In the event of a NICS background check denial or local transfer failure, the item must be returned to Nexgen Outfitters. A refund will be issued minus a 25% restocking fee, along with any applicable shipping and administrative fees.
Abandonment: Per company policy, if you fail to complete your Form 4473 background check, provide an invalid phone number, or fail to coordinate pick-up within 21 days of the item arriving at the designated FFL/SOT dealer location, the order is subject to automatic cancellation and a 10% restocking fee. Items uncollected after 90 days will be deemed fully abandoned.
5. Compliance, Accuracy, and Indemnification
Information Accuracy: You certify that all customer details provided during checkout—including your legal name, physical residential address, and transferring FFL/SOT dealer information—are 100% accurate. Providing false information to acquire a firearm or suppressed device is a federal felony.
Indemnification: You agree to indemnify, defend, and hold harmless Nexgen Outfitters, its officers, and employees from any legal liabilities, fines, penalties, or legal fees resulting from your failure to comply with local, state, or federal laws regarding suppressor ownership and state-level compliance requirements.
